SparesBay Terms of Use

Welcome to SparesBay, a platform connecting buyers and sellers of car spare parts in Kenya. By accessing or using our website, you agree to comply with these Terms of Use. Please read them carefully.
1. Platform Role
SparesBay operates solely as a platform facilitating connections between buyers and independent sellers of car spare parts in Kenya. We do not sell products directly, own inventory, or act as a seller. All transactions occur directly between buyers and sellers.
2. Payment Handling
SparesBay does not process or handle payments for transactions conducted on our platform. Payments are arranged directly between buyers and sellers. We are not responsible for payment disputes, refunds, or financial transactions.
3. User Responsibilities
- Eligibility: You must be at least 18 years old and legally capable of entering into contracts to use our services.
- Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
- Accurate Information: Users (buyers and sellers) must provide accurate and up-to-date information, including contact details and product listings.
- Compliance with Laws: All users must comply with applicable Kenyan laws, including the Consumer Protection Act, 2012, and the Competition Act, 2010.
4. Seller Obligations
- Sellers are responsible for the accuracy, quality, and legality of their listings, including ensuring that spare parts are genuine and meet advertised standards.
- Sellers must handle all customer inquiries, delivery arrangements, and after-sales services directly with buyers.
- Sellers must comply with Kenyan tax laws and regulations for all transactions.
5. Prohibited Activities
You agree not to:
- Post false, misleading, or fraudulent listings.
- Engage in illegal activities or sell counterfeit or prohibited items.
- Use SparesBay for purposes other than buying or selling car spare parts.
- Violate intellectual property rights or engage in unauthorized use of content.
6. Intellectual Property
All content on the SparesBay website, including logos, text, and design, is owned by SparesBay or its licensors and protected under Kenyan copyright laws. Users may not reproduce or distribute content without permission.
7. Limitation of Liability
- SparesBay is not liable for disputes between buyers and sellers, including issues related to product quality, delivery, or payment.
- We are not responsible for losses arising from unauthorized access to your account due to your failure to secure your credentials.
- Our platform is provided “as is,” and we do not guarantee uninterrupted or error-free access.
8. Termination
We reserve the right to suspend or terminate your access to SparesBay for violations of these Terms, illegal activities, or actions that harm the platform’s integrity, in accordance with Section 23 of the Kenya Information and Communications Act, 1998.
9. Dispute Resolution
Any disputes arising from the use of SparesBay will be resolved through negotiation or mediation. If unresolved, disputes will be subject to the exclusive jurisdiction of Kenyan courts, in accordance with the Constitution of Kenya, 2010.
10. Changes to Terms
We may update these Terms of Use to reflect changes in our operations or legal requirements. Updates will be posted on our website, and continued use of the platform constitutes acceptance of the revised terms.
